1. Acceptance of Terms
By accessing or using PermitEdge (the "Platform"), operated at permitedge.app, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Platform.
These terms apply to all users of the Platform, including individual users, administrators, safety managers, and any personnel accessing the system on behalf of an organization.
2. Description of Service
PermitEdge is a cloud-based software platform designed to help industrial facilities manage confined space entry permits in alignment with OSHA 1910.146 requirements. The Platform provides tools for digital permit creation, atmospheric testing documentation, remote authorization, compliance tracking, and audit record keeping.
The Platform is intended to support your existing safety workflows, not replace the professional judgment of qualified safety personnel.
3. Account Registration and Security
To use the Platform, you must create an account with accurate, current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
If you believe your account has been compromised, contact us immediately at mike@permitedge.app. You are responsible for notifying us promptly of any unauthorized use.
4. Permitted Use
You may use the Platform solely for managing confined space permits and related safety documentation within your organization. You agree to use the Platform in compliance with all applicable laws, regulations, and industry standards.
- Create, review, and authorize confined space entry permits
- Document atmospheric testing results and safety checklists
- Maintain digital records for audit and compliance purposes
- Manage user roles and permissions within your organization
5. Prohibited Use
You agree not to:
- Use the Platform for any purpose other than legitimate confined space permit management
- Attempt to gain unauthorized access to other users' accounts or data
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use the Platform to store or transmit malicious code or content
- Resell, sublicense, or redistribute access to the Platform without written permission from PermitEdge
- Misrepresent data, fabricate permit records, or falsify atmospheric readings within the Platform
6. Safety and Compliance Disclaimer
PermitEdge is a tool designed to support confined space permit workflows. It does not replace the employer's legal responsibility to comply with OSHA 1910.146 or any applicable federal, state, or local safety regulations.
The Platform assists with documentation and workflow management. It does not certify that any specific confined space entry is safe. The Platform does not measure atmospheric conditions, evaluate physical hazards, or verify that rescue plans are adequate.
Final safety decisions remain the sole responsibility of the employer and qualified safety personnel. Users should always verify that all on-site conditions meet applicable safety requirements before authorizing any confined space entry, regardless of the status shown in the Platform.
7. Data Ownership
You retain full ownership of all data you enter into the Platform, including permit records, atmospheric readings, facility information, and organizational data. PermitEdge does not claim any ownership rights to your content.
You grant PermitEdge a limited license to store, process, and display your data solely for the purpose of providing the Platform's services to you. We will never sell your data to third parties.
8. Intellectual Property
The Platform, including its design, code, features, and documentation, is the intellectual property of PermitEdge. All rights not expressly granted in these terms are reserved.
PermitEdge, the PermitEdge logo, and related marks are trademarks of PermitEdge. You may not use these marks without prior written permission.
9. Payment and Subscription
Pricing and subscription details for PermitEdge are currently being finalized. When available, subscription terms, billing cycles, and payment methods will be clearly communicated prior to any charges.
By subscribing, you agree to pay all applicable fees. Failure to maintain payment may result in suspension or termination of your access to the Platform. We will provide reasonable notice before any pricing changes take effect.
10. Termination
Either party may terminate this agreement at any time. You may cancel your account by contacting us at mike@permitedge.app.
We reserve the right to suspend or terminate your access if you violate these terms, engage in prohibited use, or if continued use poses a risk to the Platform or other users. We will make reasonable efforts to provide notice before termination, except in cases of serious misuse.
Upon termination, you may request an export of your data within 30 days. After that period, we may delete your data in accordance with our data retention policies.
11. Limitation of Liability
To the maximum extent permitted by law, PermitEdge shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Our total liability for any claim related to these terms or the Platform shall not exceed the amount you paid to PermitEdge in the twelve months preceding the claim. This limitation applies regardless of the legal theory upon which the claim is based.
12. Indemnification
You agree to indemnify and hold harmless PermitEdge, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Platform, your violation of these terms, or your violation of any applicable law or regulation.
13. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these terms or the Platform will be resolved in the courts located in the State of Illinois.
14. Changes to These Terms
We may update these terms from time to time to reflect changes in our Platform, business practices, or legal requirements. When we make changes, we will update the "Last updated" date at the top of this page and notify registered users via email.
Your continued use of the Platform after changes take effect constitutes your acceptance of the updated terms. If you do not agree with the changes, you should stop using the Platform and contact us to close your account.
